dispute avoidance and resolution

“A dispute arises when a disagreement impacts on the commercial interests of one or both parties to a contract”

It is widely accepted that disputes in the construction industry are costly and are a distraction that impacts management time. Dispute avoidance techniques can be used to stop disagreements escalating, saving valuable time and money, preserving professional and commercial relationships and reputations.

Armes-ADR specialises in the provision of independent neutral services in dispute avoidance and resolution for both domestic and international construction projects based on 20 plus years of experience in construction disputes.

A process by which disagreements are dealt with before they become formal disputes.

Acknowledging that formal disputes are costly in time, money and reputations, a key service is that of dispute avoidance.  With his background in architecture, Murray Armes has an overview of the whole construction process from inception, design, construction and post construction stages.  He has extensive experience in working closely and helping parties avoid disputes for the benefit of their projects and themselves.

dispute resolution

A process by which formal disputes are decided.

Sometimes it is not possible to come to agreement without a formal referral of the dispute.  The parties then have to choose a method of dispute resolution which is compatible with their contract and their priorities.  This might include a referral to adjudication, a dispute board, or arbitration or ultimately litigation. Both a Dispute Board and/or mediation may be used prior to any form of formal dispute referral.

Armes ADR is available to assist and advise parties on the most appropriate method of ADR depending on the contract and its priorities and Murray Armes is available to take appointments as arbitrator, dispute board member, adjudicator or mediator, either as a sole instruction or part of a tribunal.

Murray Armes

Murray has over forty years’ experience in the construction industry, 20 of which he has been involved in construction dispute resolution.  He has gained an established track record in dispute avoidance through his work with Dispute Boards.  With Armes-ADR, Murray continues his legacy as an independent neutral and now offers his experience as a tribunal member in arbitration, dispute boards, adjudication and mediation.
